Terms & Conditions

  1. Supply Agreement [clause 1 of the supply terms and conditions] The Kandy Factory ABN 64 320 296 592 (company) is the supplier for the ALLKANDY range of products in Australia to buyers as per agreement with ALLKANDY LLC. The buyer wishes to purchase its products direct through this website.
    By purchasing from this site you have agreed to buy the products as per these supply terms and conditions.
  2. General [clause 2 of the supply terms and conditions] ‘’The supply terms and conditions’’ means the agreement between the company and the buyer understanding the goods are purchased under the terms and conditions of the company, which may, at the companies discretion, change at any time with no prior notice to customers.
  3. Price and Payment [clause 3 of the supply terms and conditions] Prices shown are inclusive of GST. The buyer agrees to pay in addition to those prices, any freight and insurance charges. Any delivery charges will be paid in full before items are shipped to the buyers state, territory.
    All payments must be received in full by means of money transfer through its secured site before any items are shipped to the buyer. No items will be shipped prior to full payment.
    No credit is given to buyers in advance of receiving products. Company may increase its prices at any time as found in [clause 2 of the supply terms and conditions]
  4. Delivery [clause 4 of the supply terms and conditions] Delivery or despatch dates are given in good faith and are not guaranteed due to unforeseen circumstances including transport delays, bad weather. Company will not be liable for products damaged lost during transit but will, in agreement with the buyer seek the best alternate out for its replacement.
    Delivery of dangerous goods products must be to an address that accepts dangerous goods delivery or collection from the nearest holding depot. If for any reason an address is given which does not accept the goods and the delivery is re routed the buyer shall pay any cost incurred by the transport company. These must be paid in full to the company at the time of redirecting the goods. Unless otherwise agreed the buyer is responsible for unloading the products. The buyer shall take delivery of products on any day. Items not collected from the storage that incur cost and charges are payable by the buyer including any insurance charges. The company is not obliged to accept products returned by the buyer unless a prior agreement has taken place. If the company does permit the return of the products, it may charge a handling fee of up to 15% of the price of the product in question. All returns are at the cost of the buyer.
  5. Warranties [clause 5 of the supply terms and conditions] The buyer understands and agrees upon purchase; The company is a re seller of the product and not the manufacture, therefore does not offer the manufactures warranty. The company shall supply in good faith from the manufacture that all items upon delivery are sold with good title, are made with sound materials and workmanship, comply with the current published data sheets given by the manufacture, with the specification which shall be prepared with reasonable care and be suitable for the purpose for which is was intended. The company at its own discretion, can make the decision to give its own warrant on items its deems to be at fault of poor workmanship/materials upon a consultation with the original supplier [see clause 7 of the supply terms and conditions] The final decision to replace, refund or refuse a case is within the companies own time frame and will not be subject to slander or negative media broadcast, if this occurs the said warranty issue is terminated with no final outcome towards the buyer. The buyer and end user understands “2x the UV protection’’ as found in the WetWet clears are deemed twice that of the U.S standards. Kandy colours have limited light fastness and are uv sensitive therefore no warranties are given on these products.
  6. Availability [clause 6 of the supply terms and conditions] Products which are in stock will be sent once payments clear are processed. Items which are not in stock will be ordered direct from Allkandy once payments have been received [see clause 3 of the supply terms and conditions] Products which are in stock will be sent once payments (clear) are processed.
  7. Limitations of Liability[clause 7 of the supply terms and conditions] Company shall not be liable for any products which are used after notice has been given that products are deemed to be faulty or of poor workmanship/materials. Buyer shall examine products after delivery. Buyer shall then immediately notify company purchased from of any incomplete or failed delivery, loss or damage during carriage. The buyer needs to notify the company within 5 days from the date of accepting the goods, all claims connected with the matter after this time will be void. If notification is given within the 60 days and is shown to the company’s reasonable satisfaction that products are faulty and fail to comply with [clause 5 of the supply terms and conditions] the company will take action to rectify the problem.

 

All literature supplied by The Kandy Factory remains the intellectual property of The Kandy Factory and must not be reproduced or distributed between third parties or anyone other than those supplied.
